Special Rules for Members of the Military, the Foreign Service
and the Intelligence Community


Congress has acknowledged the unique circumstances affecting members of the military, the foreign service and the intelligence community by making the following exceptions that apply to both the $8,000 tax credit for first-time home buyers and the $6,500 tax credit for repeat home buyers.
Exemption From Tax Credit Recapture Rules

* Typically, homes that are sold or that cease to be used as a principal residence within three years of the initial purchase are subject to recapture of the tax credit.
* However, qualified service members who sell or move from a tax credit home within three years of the initial purchase due to official extended duty are exempt from the recapture rule.

Extension of Tax Credit Deadlines

* The home buyer tax credit is available for qualified purchases with a binding sales contract in place on or before April 30, 2010 and closed by June 30, 2010.
* However, for qualified service members who are ordered on a period of official extended duty, these dates are extended for one year. For these home buyers, the tax credit applies to sales with a binding sales contract in place on or before April 30, 2011 and closed by June 30, 2011.
* A person who is forced to return to the U.S. for medical reasons before completing an assignment of at least 90 days of qualified official extended duty outside of the United States may qualify for the one-year extension.

Definitions

* “Qualified service member” means a member of the uniformed services of the U.S military, a member of the Foreign Service of the U.S., or an employee of the intelligence community.
* “Official extended duty” means any period of extended duty outside of the United States for at least 90 days during the period beginning after December 31, 2008 and ending before May 1, 2010.

Almost all bidders for HUD listed homes for sale must use a HUD broker or an agent registered with a HUD broker to bid on a HUD home for sale. Market demand for these affordable HUD homes for sale continues to increase each and every year, so if is very important that you have a registered HUD broker before you start the bidding process.

If you have Internet access, call us and we'll walk you through accessing the available properties. If you do not have a computer or are unfamiliar with the Internet, come into our office and we will assist you in person.

HUD Homes for sale are posted on Friday and bids must be entered by the 2nd Sunday at
11:59pm.

In order to enter a bid for you on a HUD Homes, we must have: 

$1,000 ($500 for a HUD home under $50,000) earnest money in the form of a money order or
cashier's check made out to "HUD". 

A completed contract with all addendums

What Is A HUD Home?

The United States Department of Housing and Urban Development (HUD) oversees the Federal Housing Administration (FHA), which provides federal insurance on home mortgages. If a homeowner fails to make payments on a FHA loan, the mortgagee forecloses and files an insurance claim with HUD. In exchange for paying off the unpaid loan balance to the mortgagee, HUD receives title to the property. At this point, the house becomes a HUD home.

How do I buy a HUD home?

Start by finding a participating real estate agent. Your real estate agent must submit your bid for you. Normally, HUD Homes are sold in an "Offer Period." At the end of the Offer Period, all offers are opened and, basically, the highest reasonable bid is accepted. If the home isn't sold in the initial Offer Period, you can submit a bid until the home is sold. Bids can be submitted any day of the week, including weekends and holidays, (but only after the initial Offer Period). They will be opened the next business day. If your bid is acceptable to HUD, your real estate agent will be notified, usually within 48 hours.


If my bid is accepted, then what happens?

Your real estate agent will help you through the paperwork process. You'll be given a settlement date, normally within 30-60 days, by which you need to arrange financing and close the sale, or forfeit your earnest money deposit, or pay for an extension of your sales contract.
